1. Acceptance of Terms

By browsing, registering, placing an order or otherwise using the platform, you confirm that you are at least 18 years of age, competent to contract under the Indian Contract Act, 1872, and that you accept these Terms together with our Privacy Policy, Cookie Policy, Shipping Policy, Return & Refund Policy and Cancellation Policy, each incorporated herein by reference.

2. Eligibility & Account Registration

You agree to provide accurate, current and complete information when creating an account and to keep it updated. You are solely responsible for safeguarding your credentials and for all activity conducted under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that contain false information or that are used in breach of these Terms.

3. Product Listings, Descriptions & Imagery

We take reasonable care to describe products accurately, including brand, material, dimensions and country of origin. Photography is styled for editorial presentation, and minor variation in colour or finish may occur due to screen calibration and the artisanal nature of certain products. Such variation does not constitute a defect.

4. Pricing, Taxes & Payment

All prices are quoted in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Shipping charges, if any, are displayed before payment. We reserve the right to revise prices at any time prior to order confirmation. Payments are processed through PCI-DSS compliant gateways; we do not store complete card credentials.

5. Order Acceptance & Formation of Contract

Your order constitutes an offer to purchase. A contract of sale is formed only when we issue an order confirmation and, where applicable, dispatch the goods. All orders remain subject to stock availability, successful payment authorisation, serviceability of the delivery pincode and verification checks. Where a manifest pricing or listing error occurs, we may cancel the affected order and refund you in full.

6. Coupons, Offers & Loyalty Benefits

Promotional codes, gift cards and reward points are issued at our discretion, are non-transferable, cannot be exchanged for cash and are subject to the specific terms stated with each offer. We may withdraw or modify any promotion, and may reverse benefits obtained through misuse, bulk ordering or fraudulent activity.

7. Delivery, Returns & Cancellation

Dispatch and delivery timelines, return eligibility, refund settlement and cancellation windows are governed by our Shipping Policy, Return & Refund Policy and Cancellation Policy respectively. Title and risk in the goods pass to you upon delivery to the address specified in your order.

8. Prohibited Conduct

You agree not to engage in the following while using the platform.

• Placing fraudulent, speculative or bulk orders for resale without written authorisation.
• Scraping, indexing, reverse engineering or interfering with the platform or its security features.
• Uploading unlawful, defamatory, obscene or infringing content in reviews or communications.
• Impersonating another person or misrepresenting your affiliation with any entity.
• Using the platform in violation of any applicable Indian law, including foreign exchange and export controls.

9. User-Generated Content

By submitting reviews, ratings, photographs or other content, you grant PrimeBluePeak a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt and display such content for marketing and merchandising purposes. You confirm that you own or are licensed to share the content, and we may remove any submission at our discretion.

10. Intellectual Property

The PrimeBluePeak name, logo, wordmarks, site design, curated imagery, copy and software are the property of PrimeBluePeak Pvt. Ltd. or its licensors and are protected by applicable intellectual-property laws. Third-party brand marks remain the property of their respective owners. No content may be reproduced or exploited commercially without prior written permission.

11. Third-Party Brands & Sellers

Certain products are supplied by authorised brand partners and sellers. Manufacturer warranties, where applicable, are honoured by the brand in accordance with its own terms. PrimeBluePeak facilitates such claims but is not the manufacturer of these goods.

12. Disclaimers & Limitation of Liability

The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, our aggregate liability arising out of or in connection with any order shall not exceed the value of that order. We shall not be liable for indirect, incidental, punitive or consequential losses, including loss of profit, goodwill or data.

13. Indemnity

You agree to indemnify and hold harmless PrimeBluePeak, its directors, employees and partners against any claim, loss, liability or expense arising from your breach of these Terms, your violation of applicable law or your infringement of any third-party right.

14. Force Majeure

We shall not be held responsible for delay or failure in performance caused by events beyond our reasonable control, including acts of God, floods, epidemics, strikes, civil unrest, courier disruption, changes in law or failure of telecommunication and payment networks.

15. Suspension & Termination

We may suspend or terminate your access to the platform, with or without notice, where we reasonably believe these Terms have been breached or where continued access poses a risk to other customers, our partners or our systems. Accrued obligations, including payment for delivered goods, survive termination.

16. Grievance Redressal

In compliance with the Consumer Protection (E-Commerce) Rules, 2020, complaints may be addressed to our Grievance Officer at primebluepeak@gmail.com or +91 98908 54462. Complaints are acknowledged within 48 hours and ordinarily resolved within one month.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. The courts at Buldhana, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the platform.

18. Amendments

We may amend these Terms at any time to reflect changes in law, technology or our business practices. The revised Terms take effect upon publication on this page, and your continued use of the platform constitutes acceptance.
